Among investors, there are many questions about whether NFOŚiGW funding can be combined with Capacity Market revenues. To clear up any doubts, we analyzed the regulation on the funding and the Capacity Market.

🔎 Here are two key conclusions:

1️⃣ An investor who has signed a capacity agreement can apply for funding from NFOŚiGW.

📌 Legal basis: Dz.U. 2025 poz. 280 → §11

Quote: "State aid cannot be combined with other public aid, except for compensation for fulfilling the capacity obligation under a capacity agreement, as referred to in Chapter 6, Section II of the Act of December 8, 2017, on the Capacity Market."

2️⃣ The amount received from NFOŚiGW funding must be spread over the duration of the capacity contract and deducted proportionally from each monthly invoice.

📌 Legal basis: Dz.U. 2023 poz. 2131 → Art. 62.

Quote: "The remuneration for fulfilling the capacity obligation for a new and modernized capacity market unit shall be reduced by the amount of investment aid granted for the construction or modernization of that unit."

What does this mean?

✅ You can receive NFOŚiGW funding and participate in the Capacity Market.

❌ However, it does not mean a "double benefit" – the funding amount will be gradually deducted from Capacity Market compensation.
